Taxpayer adopting or who adopted an eligible child
Entitlement facts
Benefit type
Tax credit. A credit claimed under tax law that can reduce eligible tax liability and may be refundable only when the governing rules say so. Taxonomy definition →
What it unlocks
A credit for qualified adoption expenses and an exclusion for qualifying employer-provided adoption assistance, subject to current annual limits.
Who qualifies
Taxpayer adopting or who adopted an eligible child
Requirements
The adoption, child, expenses, timing, income, and filing status must meet IRS rules. Expenses reimbursed by another source generally cannot be claimed again, and special-needs adoption rules differ.
How to activate
Keep adoption and expense records, review the current IRS rules, and file Form 8839 with the federal income tax return.
Cost basis
Subsidized or partially covered. A government, nonprofit, employer, insurer, scholarship, or other sponsor pays some or all eligible costs; the user's remaining amount depends on the award and program rules.
Cost and fees
No government fee to claim. Adoption expenses and any professional tax-preparation costs remain the taxpayer's responsibility; the credit may not reimburse every expense.
